Sharps Disposal Laws in California

California sharps disposal laws covering healthcare facilities, home users, tattoo studios, and pharmacies in 2026.

California sharps disposal law sits at the intersection of three regulatory frameworks: the California Medical Waste Management Act, Cal/OSHA Bloodborne Pathogens, and federal OSHA. Compliance with all three is required for any facility generating sharps waste, with home-generated sharps handled under a separate H&SC provision.

This guide covers the four key laws, the container standards that apply universally, and the most-cited compliance gaps.

Four Key Laws

California Medical Waste Management Act, sharps provisions

H&SC 117750

Defines sharps waste, requires CDPH-permitted disposal pathway, mandates puncture-resistant containers, and regulates transport and treatment.

OSHA Bloodborne Pathogens Standard

29 CFR 1910.1030

Federal worker-protection rule. Requires sharps containers that are closable, puncture-resistant, leakproof, and color-coded or labeled with biohazard symbol. Annual training required.

Cal/OSHA Bloodborne Pathogens

8 CCR 5193

California-specific bloodborne pathogen rule, stricter than federal. Requires written Exposure Control Plan, sharps injury log, hepatitis B vaccination offer.

Home-generated sharps

H&SC 118286

Prohibits home sharps in residential trash. Authorizes pharmacy and HHW program acceptance of home-generated sharps in approved containers.

Sharps Container Standards

  • Puncture-resistant: rigid plastic walls that cannot be penetrated by needles or sharp instruments under normal use.
  • Leakproof on sides and bottom: containers cannot allow liquid leakage during transport or storage.
  • Color-coded or labeled with biohazard symbol: typically red, with the international biohazard symbol displayed.
  • Closable: hands-free closure mechanism that allows safe insertion of sharps without exposure to the sharps already inside.
  • Sized appropriately: containers must be replaced before sharps reach the fill line (typically 3/4 full).
  • Mounted or placed near the point of use: at the bedside, on the lab bench, in the operatory, in the immunization room.

FAQ

No. California H&SC 118286 prohibits sharps in residential or commercial trash. Healthcare facilities use CDPH-permitted medical waste pathways. Home users (insulin patients, veterinary pet owners) use pharmacy takeback or county HHW programs that accept home-generated sharps.

Containers must be puncture-resistant, leakproof, closable, and color-coded red or labeled with the biohazard symbol per Cal/OSHA 5193 and OSHA 1910.1030. Hard rigid plastic with a hands-free closure mechanism is standard. Sizes range from 1 quart to 18 gallons.

Containers should be sealed and replaced before reaching the fill line, typically when 3/4 full. Most facilities establish a routine exchange schedule based on volume; very high-volume locations may exchange weekly, while solo dental practices may exchange monthly or quarterly.

Many California pharmacies accept home-generated sharps in approved containers. Some county HHW programs also accept them. Mail-back sharps disposal kits, sold through compliance providers including BAC, are another option. Check H&SC 118286 for the authorized disposal pathways.

Yes. Tattoo studios, body-art shops, and piercing operations are regulated as biohazard waste generators in California. Same container standards, same Cal/OSHA bloodborne pathogen training requirements, same CDPH-permitted disposal pathways.

Per Cal/OSHA 5193(h)(5), employers must maintain a log of sharps injuries that includes the type and brand of device involved, the work area where the injury occurred, and an explanation of how the incident occurred. The log is retained for the duration of employment plus 30 years for affected employees.

Yes. BAC provides scheduled sharps container exchange, mail-back kits for low-volume generators, and the Cal/OSHA-compliant training, exposure control plans, and sharps injury logs required to satisfy all applicable rules. COMPLIANCE|360 at $360/mo includes sharps service.
