Overview
Compliance training is the recurring instruction that healthcare employers are legally required to provide to anyone with occupational exposure to blood, body fluids, hazardous chemicals, or protected health information. Federal OSHA requires bloodborne pathogen training at initial assignment and at least once every year, and California layers on Cal/OSHA rules for aerosol transmissible diseases, hazard communication, and your written Injury and Illness Prevention Program. HIPAA adds mandatory privacy and security awareness training for every workforce member who touches patient data. None of this is a one-time checkbox, it has to be delivered, repeated on schedule, and documented.

Regulatory Framework

OSHA Bloodborne Pathogens
29 CFR 1910.1030
Federal OSHA standard requiring training for all employees with occupational exposure to blood or other potentially infectious materials, at the time of initial assignment and at least annually thereafter. Training records must be kept for three years.
Cal/OSHA Aerosol Transmissible Diseases
8 CCR 5199
California-specific rule for facilities where staff are exposed to airborne and droplet pathogens. Requires an exposure control plan and annual ATD training, with refreshers due within 365 days of the prior session for employees who continue to work with ATD pathogens.
Cal/OSHA Injury and Illness Prevention Program
8 CCR 3203
Every California employer must maintain a written IIPP whose training element requires instruction for all new hires, for new job assignments, and whenever a new hazard, substance, process, or piece of equipment is introduced into the workplace.
Cal/OSHA Hazard Communication
8 CCR 5194
California's right-to-know standard requires training on the chemicals employees handle, including disinfectants, fixatives, and sterilants, covering label and Safety Data Sheet interpretation and protective measures, with retraining whenever a new chemical hazard appears.
HIPAA Privacy and Security Training
45 CFR 164.530(b), 164.308(a)(5)
The Privacy Rule requires training every workforce member on policies for protected health information, and the Security Rule requires a security awareness program for all staff. Training is due after hire, when policies materially change, and periodically thereafter, with records retained six years.
DOT HazMat Employee Training
49 CFR 172.704
Staff who package, label, or ship regulated medical or hazardous waste are hazmat employees who must receive general awareness, function-specific, safety, and security training, with recurrent training at least once every three years.
Penalty Warning
Missing or undocumented training is among the most common findings in a Cal/OSHA healthcare inspection. Federal OSHA penalties currently reach $16,550 per serious violation and $165,514 per willful or repeated violation, and Cal/OSHA assesses comparable amounts. Separately, HIPAA training gaps can trigger HHS Office for Civil Rights enforcement, where penalties scale with the level of culpability and can climb into six and seven figures for systemic noncompliance.
