What This Means for Your Facility
Chain of custody documentation serves as the legal record that waste was handled properly at every point between generation and final disposal. For hazardous waste, RCRA requires a Uniform Hazardous Waste Manifest (EPA Form 8700-22) that must accompany every shipment and be signed by the generator, transporter, and receiving facility. For controlled substance destruction, the DEA requires additional witnessed destruction documentation with signatures from two authorized employees. California's DTSC adds state-specific manifest requirements beyond the federal form.
Gaps in chain of custody create serious liability. If a manifest is missing, unsigned, or shows discrepancies between what was shipped and what was received, the generator remains liable for that waste, potentially indefinitely. Under RCRA's "cradle to grave" principle, generators can be held responsible for cleanup costs even decades later if waste ends up at a Superfund site. The exception report requirements (40 CFR §262.42) obligate generators to investigate and report any manifest that has not been returned by the receiving facility within 35 days (LQG) or 60 days (SQG).
